The Subordinate Judiciary in Madhya Pradesh will now be referred to as District Judiciary and the Lower Courts as Trial Courts as per Supreme Court circular.
This was decided in a full session of the Madhya Pradesh High Court, which was attended by Chief Justice Ravi Malimath and other judges on Friday.
“All courts other than the High Court are further referred to as District Judiciaries and not as Subordinate Judiciaries and that all Courts other than the High Court are referred to as Courts of First Instance and not as Subordinate Courts,” it reads.
The circular is issued on the orders of the Chief Justice of MP and signed by its Chief Secretary Ramkumar Choubey.
“The purpose of the resolution on abuse of subordinate judiciary and subordinate courts is to conclude that every court is independent within its jurisdiction,” the HC’s senior registrar told PTI.
He said when Chief Justice Malimath of the Supreme Court was serving as the Chief Justice of Himachal Pradesh, a similar resolution was passed in a full court session there.
Last month, Chief Justice of India DY Chandrachud asked Supreme Court and High Court judges to avoid a “colonial mindset” and “culture of subservience” when dealing with district court judges, saying the country must move towards a “more modern and equal judiciary”. .
